By uploading an album, the User agrees to the Terms & Conditions for the use of MyAlbum.ca. These Terms & Conditions are updated on a regular basis.
In these Terms & Conditions for the use of MyAlbum.ca, the following terms are used with the corresponding meaning:
User: a natural person who has signed up by way of an e-mail address.
Account: the possibility to use MyAlbum.ca.
Conditions: these Terms & Conditions.
MyAlbum.ca takes the privacy of its users extremely seriously. MyAlbum.ca will only use the provided information by the users to deliver and improve the service. User data will not be given to any third party without the permission of the user*.
(*) When user information is legally claimed, and the course of justice will otherwise be obstructed, MyAlbum.ca will make the information available.
MyAlbum.ca collects data for proper functioning of the site. The data collections will take place by using IP data and cookies. With this data, MyAlbum.ca has the possibility to target the services to the wishes of the users. Problems on an individual level can also be solved quickly. The service and the usability of the user of MyAlbum.ca will be improved accordingly.
MyAlbum.ca is not in any way responsible for the damage or loss of data.
The user can store his or her photos for an unrestricted period of time, as long as the user logs in once every 67 days, or the photos are viewed by family or friends. When this does not happen, the user will receive an e-mail after 60 days with the message that he or she has to log in or the photos have to be viewed by family or friends. When this does not happen within 7 days, the photos will be deleted.
MyAlbum.ca exerts itself to protect data against loss and/or any form of unlawful use.
The user is responsible for the content. The copyright of the uploaded content belongs to the user. The user is responsible for the possible consequences of the violation of the copyright of third parties.
If there is the suspicion that the graphical material disclosed by the user through MyAlbum.ca causes a felony or misdemeanor, MyAlbum.ca reserves itself the right to report this crime to the appropriate law enforcement agencies, following the procedure applicable law stipulates. The user will not be informed of this course of action, nor will this be explained to him or her.
The users of MyAlbum.ca upload photos without the interference of MyAlbum.ca.
MyAlbum.ca reserves the right to delete albums that are made public by the user (Public Albums) or move these albums to another category. The definitions under Copyright are applicable to the albums that are made public.
Applicable law/ authorized court
These Terms & Conditions will be governed by Dutch law.
Dutch law is applicable to all legal relationships between MyAlbum.ca and the user.
Any legal issues that might arise from these agreements or agreements derived from these agreements, will be settled in Dutch court. The procedure will be conducted in the Dutch language.
When a user creates an account at MyAlbum.ca, he or she automatically subscribes to MyAlbum.ca's newsletter. This subscription can be terminated via www.myalbum.ca or through the newsletter.
